  • Is it mandatory to hire a real estate lawyer for my closing?

    Yes. Current legislation in Delaware mandates the physical presence of an attorney at real estate closings.

  • What is the difference between a real estate attorney and a real estate agent?

    They perform different roles. A real estate agent (or realtor) helps clients buy or sell property and typically earns a commission based on the sale price. A real estate attorney provides legal advice and assistance throughout the transaction process, including drafting and reviewing contracts, conducting due diligence, and resolving title disputes.

  • What do you charge for an initial consultation?

    Our initial consultation fees start at $300. If we proceed with any legal service, those $300 are applied toward our fees, and the consult is free.

  • What are your fees?

    Our fees vary depending on the case. For settlement/closing fees, our price range is from $1400-$1600. Any additional matter is charged on an hourly basis, case by case.

  • What are the costs associated with my closing?

    There is no one-size fits all formula. We encourage you to use our estimate generator for an accurate estimate. However, generally, the most common fees when closing on your home include the following:

    Financing Fees

    Lender origination fee – they are typically about 1% of your loan amount.

    Home appraisal fee – the fee ranges between $400-800

    Credit Report Fee – Lenders should charge around $30

    Legal Fees

    Attorney Fees – the estimate range is $1400-$1600 (Includes Title Exam and Attorney Review Fee, Settlement, Admin Fees, and Transaction Coordination)

    State Fees

    Deed and Mortgage Recording Fee – The government charges per page for recording should total around $58-$109.

    Transfer Taxes – The state of Delaware charges a transfer tax rate of 4% of the sale price. Generally, it is split between buyer and seller.

    Property Taxes – Delaware charges a 0.52% property tax from the property value. This can vary on a county or city basis.

    Additional Fees

    Lender/Owner’s Title Insurance – This will depend on property value.

    Current HOA Fees vary depending on the community and the established Homeowners Association fee.

    Survey Fees – Ranges from $625- $1200

    Inspection Fees - Approximate of $500 - $1,000

  • How long does the real estate transaction process usually take?

    It can vary in length depending on factors such as the type of property being bought or sold, the complexity of the transaction, and the parties involved. Generally, the process can take around 30 days. However, we can expedite cash deals or seller financing transactions with awesome lenders on the other side.

  • What are some common issues that arise during real estate transactions?

    Some issues that can arise during real estate transactions include issues with the property’s title, zoning, and land use restrictions, environmental issues, and disputes over contract terms or pricing.

  • Do you handle cases outside of Sussex County?

    Yes. Call us to book an appointment and discuss, but we do handle cases virtually if needed or throughout the Sussex & Kent County, Delaware area.
